Cultivate Clarity, LLC Liability Release
In consideration of and as an inducement to my enrolling as a student or therapy client of Cultivate Clarity LLC, also known as Cultivate Clarity - Energy Healing at 599 North Ave. Door 6, Floor 1, Wakefield MA 01880, I represent and agree as follows:
I have been fully examined by a licensed physician and have been found to be in good physical health and fully able to perform all yoga exercises and or participate in all wellness workshops and therapy services provided by Cultivate Clarity, LLC and all teachers, therapists, and presenters in service of Cultivate Clarity, LLC. I hereby represent that I have no medical or physical condition that would prevent me from properly using any of Cultivate Clarity, LLC's services and facilities. I do not have a physical or mental condition that would put me in any physical or medical danger, and I have not been instructed by a physician to not participate in physical exercise. I acknowledge that if I have any chronic disabilities or conditions, I should not be participating in any services at Cultivate Clarity, LLC.
I will not hold Crystal Reynolds, Cultivate Clarity LLC, its partners, instructors, therapists or employees liable. In the event of any injury, I assume full responsibility for myself and any consequences I may incur while attending classes, workshops or sessions at Cultivate Clarity LLC. I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or damages that may result from participation in Cultivate Clarity, LLC.
I understand and acknowledge that I am to receive instruction in yoga theory, exercise, and/or bodywork practices such as Polarity Therapy or other energy healing and wellness practices. I will not hold Crystal Reynolds or Cultivate Clarity LLC to any higher standard of care than that applicable to those practices. I understand the certifications of Crystal Reynolds, Cultivate Clarity LLC’s partners, instructors, therapists or employees do not supersede my own personal responsibility nor are they responsible for my personal interpretation and understanding of my body, my health, and my life choices.
Release: I am willingly and voluntarily participating in the services available at Cultivate Clarity, LLC. I hereby release Cultivate Clarity, LLC, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my participation in this service, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. If I am signing on behalf of a minor child, I also give full permission for any person connected with Cultivate Clarity, LLC to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well-being of the child.
Cancellation Policy: All sales are final and non-refundable. Pre-paid appointments expire 1 year from the purchase date. When canceling or rescheduling your appointment we require a minimum of 24 hours notice. Appointments canceled with less than 24 hours notice will incur a charge of 50% of the service amount. Clients that do not show up to an appointment will incur a charge of 100% of the service amount or lose one of their pre-paid appointments. The payment for services made herewith and such fees paid hereafter are non-refundable; such refunds if any, as are made, shall be entirely within the discretion of Cultivate Clarity LLC.
Indemnification: The participant recognizes that there is risk involved in the types of classes and workshops offered by Cultivate Clarity, LLC. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Cultivate Clarity, LLC, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Cultivate Clarity, LLC
Valuables and personal property: I acknowledge that I have been urged to avoid bringing valuables onto the Facilities and that Cultivate Clarity, LLC shall not be liable for the loss of, theft of, or damage to my personal property, including items in bathrooms, studio, parking lots or anywhere else in the facilities. I acknowledge that no portion of any fees paid by me is in consideration for the safeguarding of valuables.
Photo/Video Release: I hereby grant Cultivate Clarity, LLC permission to use my photograph/video image taken at Cultivate Clarity in any and all publications for Cultivate Clarity, LLC, including web site entries, without payment or any other consideration in perpetuity. I hereby authorize Cultivate Clarity, LLC to edit, alter, copy, exhibit, publish or distribute all photos and images taken at Cultivate Clarity. I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my photo appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph or video images.
Termination: Cultivate Clarity, LLC reserves the right to immediately terminate my use of, or access to, the premise at any time if Cultivate Clarity, LLC decides at its sole discretion that I have breached this Agreement or any relevant law, rule or regulation or I have engaged in conduct that Cultivate Clarity deems to be acting in an inappropriate or unsafe manner.
I hereby hold harmless and release and forever discharge Cultivate Clarity, LLC from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf of on behalf of my estate which may have or may have by reason of this authorization. I am competent to contract in my own name. I have read this release, and I fully understand the contents, meaning, and impact of this release.
I have read this agreement and fully understand its terms, and understand that I am giving up substantial rights including my right to sue Cultivate Clarity, LLC under certain circumstances. I acknowledge that I am providing this waiver freely and voluntarily. The term of this waiver is indefinite.
By entering into any class, workshop/event, or session at Cultivate Clarity LLC you understand and agree:
Crystal Reynolds and all of Cultivate Clarity LLC’s partners, instructors, therapists or employees are not licensed physicians. The treatments offered including but not limited to Polarity Therapy and Yoga are alternative/complementary energy healing services which there is currently no licensure in the State of Massachusetts. There are however Standards for Practice and a Code of Ethics for practicing Polarity Therapy which are outlined by Live More Realized, the Educational Institute Crystal Reynolds received her Polarity Certificate of Completion from. As well Yogaspirit 200 hour yoga certification.
Theory of Treatment & Nature of Services: The Polarity Therapy Sessions, Workshops and Yoga Classes offer clients a theoretical model for understanding and working therapeutically with the Human Energy Field. This is a holistic model for health that supports energy balancing and embodied consciousness as a pathway toward physical, mental and emotional wellness. Sessions may include:
Manual interventions such as touch-therapy and physical contact with the body to support energy movement and balancing.
Verbal interaction may include guided meditation and somatic exploration (using one’s awareness to bring attention to one’s internal being), inquiry into the client’s overall experience, sensation and perceptions, verbal exercises and dialogue that support an awareness of energy dynamics and encourage energy balance. Physical movement and movement education, stretching and exercises. Client education concerning diet and nutrition from an energetic perspective.
I understand that Polarity Therapy is complementary to my existing healthcare. It is not a replacement for medical care, psychotherapy or psychiatry, physical therapy or massage, work with a nutritionist or dietician, or any other form of licensed healthcare. If I have any health concerns I will consult the appropriate licensed healthcare provider and cease participation in all offerings at Cultivate Clarity LLC including but not limited to Polarity Therapy Sessions, Yoga classes and Workshops. If I require medical, psychological or physical support I know it is my responsibility to seek those resources. I understand Polarity Therapy is meant for spiritual support, not prescription or healthcare information. Crystals, essential oils, services, and products sold or participated in through Cultivate Clarity, LLC are not intended to diagnose, treat or substitute medical care or medical advice.
Concerning Touch-Therapy: A key part of Polarity Therapy involves touch. By entering into this agreement, I agree to receive touch-therapy as part of the session. I understand I may withdraw consent to receive touch at any time by verbally alerting Crystal Reynolds at that point the session will end.
I agree to remain fully clothed during the touch therapy. The touch therapy is intended to feel safe, comfortable, non-invasive, and non-aggressive at all times, without any sensual, erotic or sexual undertones. If at any point the touch is felt as uncomfortable or aggressive or in any way unsafe by myself or Crystal Reynolds the session will immediately end.
Self-Responsibility: By agreeing to participate in services at Cultivate Clarity including but not limited to Polarity Therapy sessions and/or yoga classes at my own freewill, I am acknowledging that the therapy can involve personal development and that I am responsible for ensuring that I have the resources for appropriate self-care. I am responsible for managing my own personal well-being. All services were fully explained to me, my questions have been answered, I fully understand and herby agree to participate in services at Cultivate Clarity LLC.
